General conditions - DOUDARD FURNITURE

Article 2-1: Capacity 
When placing the Order, the Customer guarantees to have full legal capacity to adhere to these general conditions and to enter into a sales contract with Doudard SAS furniture.
For any payment by card, the Customer guarantees that it is fully entitled to use the card and that it gives access to sufficient funds to cover all the costs necessary to pay the Order.

Article 2-2: Personal Information
When placing an Order, the Customer agrees to provide the information requested of him and undertakes to ensure the veracity of the latter:

Article 2-4: Order Processing
Orders are processed in the order in which they are actually received and upon payment validation.

Article 3: PRICE

The prices are indicated at the time of the Order and are only valid for deliveries in mainland France. For other destinations, prices are on request.

The date of availability of the Product is indicated at the time of placing the order by the Customer.

In case of unavailability of the ordered Product, the Customer will be informed as soon as possible and will have the opportunity to cancel the order. The Customer will then have the choice to request either the refund of the sums already paid at the latest within thirty days of payment, or the exchange of Product with characteristics and equivalent prices.

In case of impossibility of exchange, DOUDARD SAS furniture reserves the right to cancel the order and refund the sums paid.

Article 6: DELIVERY

Place and date of delivery are determined by the parties.

Article 6-1: Delivery schedule
Unless otherwise stipulated in these General Terms and Conditions of Sale, delivery costs are always borne by the Customer.
The delivery period is agreed by the Parties at the time of placing the Order, according to the possibilities of supply and transport of Meubles DOUDARD SAS and in the order of arrival of the orders.

Article 6-2: Delivery by Carrier

Article 6-4: Delivery Times

The Carrier sets itself the duration of the loss investigation. 
The investigation is opened within 24 working hours following the transmission by the Customer to Meubles DOUDARD SAS of the information on the non-receipt of his Order as well as the documents necessary for the opening of this investigation that Meubles DOUDARD SAS is likely to ask the customer. If during the investigation period, the Product is found, it is delivered to the Customer.
If the Product is not found at the end of the investigation and only on this condition, Meubles DOUDARD SAS will ship a replacement Product at its expense if the Product is still available.

In any case Meubles DOUDARD SAS will not proceed to the exchange or the refund of the Product before the expiry of the inquiry period and the Customer will not be able to turn against this fact against Meubles Doudard SAS.

Article 6-5: Special Cases
Deliveries of bulky and / or fragile products made by another carrier than the Post Office are limited to Metropolitan France excluding islands not connected to the mainland by a bridge. (Corsica, Ile d'Yeu, Porquerolles Island, etc.)
Other orders give rise to quotes.
Meubles DOUDARD can not be held responsible for delivery problems resulting from difficulties in accessing the place of delivery. The consequences of these difficulties weigh on the purchaser. Article 6-6: Delayed Delivery

Article 7-1: General
According to Article L 121-20 of the Consumer Code, the Customer has a period of seven clear days from receipt of the Products to exercise his right of withdrawal without having to justify any reason or to pay penalties .

Article 7-2: Exception

In all other cases:

The risks associated with the return of the Product, whatever the cause, are incumbent on the Customer. The only case where the cost of return transport of the Product is reimbursed to the Customer is the one where the return is caused by an error on the part of Meubles DOUDARD SAS.
If the Customer chooses reimbursement, Meubles Doudard will make every effort to reimburse the Customer as soon as possible.
If the Customer is reimbursed by bank credit, the speed with which the bank account is credited depends on the type of credit card of the Customer: in the case of a debit card, the current account is credited under 3 8 days based form the bank ; in the case of a deferred debit card, the credit appears at the end of the month on the credit card account and not on the current account. Article 10: GUARANTEES

Article 10-1: Legal Warranty
The Customer may, in any event, avail himself of the legal guarantee of conformity provided for by articles L.211-4, L.211-5, L.211-12 of the Consumer Code and articles 1641 and 1648 paragraph 1 of the Civil Code.

Article 10-2: Conventional guarantee of the "manufacturer"

MEUBLES DOUDARD SAS reserves the right not to take back the goods to be replaced.

Any product required to benefit from the warranty must first be submitted to the after-sales service of Meubles DOUDARD SAs whose agreement is essential for any replacement or for any repair.

To benefit from the guarantee of the Products, the Customer must imperatively keep the invoice for the purchase of the Product.
In the case of a product replacement following the assumption of the After Sales Service, only the manufacturer is authorized to determine the type of transport and delivery.

Article 11: LIABILITY

Meubles DOUDARD SAS undertakes to describe with the greatest accuracy the products sold on the Site.
